TERMS AND CONDITIONS OF USE

Junior MBA – Career Accelerator Program Offered by British Learning
1. DEFINITIONS AND INTERPRETATION

For the purposes of these Terms and Conditions (“Terms”):

  • “British Learning” means the educational institution offering the Junior MBA – Career Accelerator Program, including its proprietors, directors, employees, facilitators, contractors, affiliates, and authorised representatives.
  • “Programme” refers to the Junior MBA – Career Accelerator Program including all academic modules, exposure components, community service activity, guided internship exposure, documentation, certifications, platforms, tools, content, and communications.
  • “Participant” refers to the enrolled student.
  • “Parent / Guardian” refers to the natural or legal guardian of the Participant where the Participant is below eighteen (18) years of age.
  • “Platform” includes LMS, CRM systems, internal dashboards, training tools, communication systems, and any proprietary or third‑party software used for Programme delivery.

Unless the context otherwise requires, words importing the singular shall include the plural and vice versa.

2. LEGALLY BINDING ACCEPTANCE

By clicking “I Agree”, registering, enrolling, making payment, accessing Programme material, attending sessions, or permitting the Participant to do so, the Participant and/or Parent/Guardian:

  • Enters into a legally binding electronic contract with British Learning;
  • Confirms free, informed, and voluntary consent in accordance with the Indian Contract Act, 1872;
  • Acknowledges enforceability under Section 10A of the Information Technology Act, 2000, recognising electronic contracts as legally valid;
  • Confirms that electronic acceptance is equivalent to a physical signature.

Failure to accept these Terms shall result in denial of access without liability to British Learning.

3. MINORS & GUARDIAN CONSENT (CRITICAL CLAUSE)

3.1 The Programme permits enrolment of minors. Where the Participant is under eighteen (18) years of age:

  • Registration must be completed by the Parent/Guardian.
  • The Parent/Guardian shall be the primary contracting party.
  • The Parent/Guardian assumes full legal, financial, behavioural, and supervisory responsibility for the Participant.

3.2 The Parent/Guardian expressly represents and warrants that:

  • They understand the nature, scope, and limitations of the Programme;
  • They consent to the Participant’s participation, data processing, communication, and exposure to learning systems;
  • British Learning does not assume the role of custodian, caregiver, or guardian in any capacity.

3.3 British Learning shall not be responsible for any personal, emotional, psychological, behavioural, or external consequences arising from the Participant’s interpretation or independent actions.

3A. UGC, AICTE & NEP 2020 DISCLAIMER

3A.1 The Company is not affiliated with, recognized by, approved by, or regulated by the University Grants Commission (UGC), All India Council for Technical Education (AICTE), the Ministry of Education, or any statutory educational authority.

3A.2 Nothing on the Platform shall be construed as offering UGC‑recognized degrees, AICTE‑approved programs, statutory qualifications, or regulatory equivalence.

3A.3 The National Education Policy, 2020 (NEP 2020) is a policy framework only. Participation does not imply compliance, entitlement, or institutional recognition under NEP 2020.

4. NATURE OF THE PROGRAMME – NO MISREPRESENTATION

4.1 The Programme is a career exposure and skill‑building initiative intended for:

  • Awareness building,
  • Profile development,
  • Practical understanding,
  • Interview‑oriented communication preparedness.

4.2 The Programme does not constitute:

  • A degree, diploma, or formal qualification recognised by any statutory authority;
  • An employment, apprenticeship, or vocational placement;
  • A guarantee of university admission, internship conversion, or job offer;
  • A substitute for school, college, or professional education.

4.3 All examples, demonstrations, simulations, and exposures are illustrative in nature.

5. NO GUARANTEE / NO ASSURANCE CLAUSE

The Participant and Parent/Guardian expressly acknowledge that:

  • University admissions are determined by independent institutions based on criteria beyond British Learning’s control;
  • Employment and hiring decisions are solely at the discretion of employers;
  • Academic, professional, or career outcomes depend on multiple external and personal factors.

Accordingly, no guarantees, warranties, or assurances are provided—express or implied—regarding admissions, placement, earnings, selection, or success.

6. INDEPENDENCE & NON AFFILIATION

British Learning operates as an independent educational entity.
No association, partnership, endorsement, representation, or agency relationship exists with any university, employer, recruiter, or organisation unless explicitly stated in writing.

7. PROGRAMME DELIVERY, MODIFICATION & DISCRETION

British Learning reserves the unrestricted right to:

  • Modify curriculum, content, timelines, faculty, or instructional methods;
  • Transition between live, recorded, online, hybrid, or observational formats;
  • Update materials to reflect industry or operational requirements.

Such changes shall not constitute deficiency of service under the Consumer Protection Act, 2019.

8. CERTIFICATIONS

8.1 The guided internship exposure component is purely observational and educational.

8.2 Participants:

  • Do not perform operational, revenue, or decision‑making tasks;
  • Are not employees, interns, trainees, or contractors;
  • Are not entitled to stipends, salaries, benefits, or employment rights;
  • Do not create any employer–employee relationship.

8.3 Any exposure to business systems is solely for learning demonstration purposes.

9. INTELLECTUAL PROPERTY

9.1 Participants may be granted limited access to internal systems including LMS and CRM environments.

9.2 Such access constitutes confidential and proprietary business information.

Participants shall not:

  • Record, copy, screenshot, download, or replicate any system;
  • Share credentials or content with third parties;
  • Use information for personal or commercial gain.

Violation may lead to immediate termination and legal action under the Information Technology Act, 2000 and applicable data protection laws.

10. INTELLECTUAL PROPERTY RIGHTS

All Programme materials are the exclusive intellectual property of British Learning protected under the Copyright Act, 1957 and associated laws.

Unauthorised reproduction, distribution, resale, or commercial exploitation is strictly prohibited.

11. DOCUMENTATION & CERTIFICATIONS

Certificates, transcripts, reports, and letters are indicative of participation and exposure, not professional competence certification.

British Learning reserves the right to withhold or revoke documentation in cases of misconduct, misuse, or misrepresentation.

12. FEES, CANCELLATION & REFUND

100% refund is available strictly within 24 hours of payment, provided no content has been accessed.

Post‑access, all fees are non‑refundable without exception.

13. USER CONDUCT & TERMINATION

British Learning may suspend or terminate access without notice in cases of:

  • Misuse of systems,
  • Behavioural misconduct,
  • Confidentiality breach,
  • Disruption or misrepresentation.

No refund shall be applicable.

14. LIMITATION OF LIABILITY

British Learning shall not be liable for indirect, incidental, consequential, or third‑party damages.

Maximum liability, if any, shall be limited to fees paid.

15. INDEMNITY

The Participant and/or Parent shall indemnify and hold harmless British Learning against claims arising from:

  • Breach of Terms,
  • System misuse,
  • Actions of the minor,
  • Third‑party claims.
16. DATA PRIVACY & COMMUNICATION CONSENT

Data shall be handled in accordance with the Digital Personal Data Protection Act, 2023.
Participants consent to communication via email, call, or messaging platforms.

17. FORCE MAJEURE

British Learning shall not be liable for disruptions beyond reasonable control.

18. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.
Jurisdiction: Mumbai, Maharashtra.

19. ENTIRE AGREEMENT & NON RELIANCE

These Terms, together with programme disclosures and refund policy, constitute the entire agreement.
No reliance is placed on verbal statements or informal assurances.

20. FINAL ACKNOWLEDGEMENT

By proceeding, the Participant and/or Parent confirms full understanding, acceptance of limitations, and informed consent.
